A person who cannot return to her own country because she fears persecution may apply for asylum in the United States. A person who is outside the United States and who cannot stay in or return to his or her country because of fear of persecution may apply for refugee status.

A non-immigrant can be an investor in the U.S. Non immigrant E-2 long term,/Retiree /Foreign investors visas are available.

Cancellation of Removal for Domestic Violence is available under VAWA. Asylum for Domestic Violence is possible.

“V” Visa is available to the spouses and minor children of Lawful Permanent Resident. K-3 visa is available for spouse of a U.S citizen. K-4 is for children of K-3.

K” Visa is a temporary status available to the fiancée of a U.S. citizen and that fiancée’s children after the approval of a fiancée petition, or to the spouses and minor children of U.S. citizens who are waiting outside the United States for the approval of an immigrant visa petition.

“Immigrants” generally intend to make the U.S. their home. An immigrant can be granted lawful permanent residence, also known as a green card, through a family member/employment by filing I-130. Certain convictions may cause to lose one's green card. T/U visa holders may apply for permanent residence after 3 years.

The general rule is “Non-immigrants” are only granted visas for a temporary period and a specific purpose—not to make the U.S. their home. However, there are some options available for some extensions, family reunion and employment opportunities like, SEVIS/Non-SEVIS PROCESS, EAD, Student employment and training approval. M-2 status for Spouse, and minor children of M-1 student, Extension of Non-immigrant Status. Over stayed student visa I-94, F-1, J-1, M-1 or visitor's visa, and other possibilities.

“T” visas are available to victims of “a severe form of trafficking in persons,” who are in the U.S. because of the trafficking, and who would suffer “extreme hardship involving unusual and severe harm” if removed from the U.S. This visa is also available to the victim’s spouse and children (and parents, if the victim is under 21 years old).

The “U” visa is available to immigrants who are victims of certain enumerated forms of criminal activity, possess information concerning that criminal activity and would be helpful to the investigation or prosecution of that criminal activity.
