Asylum is a form of protection granted to individuals in the United States who have been persecuted or fear they will be persecuted on account of their Race; Religion; Nationality; Membership in a particular social group; or Political opinion. Asylum applications must be filed within one year of applicant’s entry in United States. Motions to vacate criminal convictions are among the most important and effective ‘tools’ an experienced immigration and criminal defense attorney has to defend a foreign born client in immigration court removal (deportation) proceedings. This motion to vacate is filed in the California state court where the criminal conviction occurred. The grounds for filing this motion arise when the non-citizen was not adequately informed by the judge or the defense attorney about the adverse immigration consequences of being convicted of the crime for which the non-citizen has pled guilty or no contest. This motion can be brought even many years after the non-citizen was sentenced. If the criminal conviction is vacated, then the underlying immigration removal proceeding can be terminated because there would no longer be a criminal conviction upon which the government could rely to deport that person. Motions to modify conviction(s) are brought for non-citizens whenever their prior criminal conviction(s) are classified by the U.S.C.I.S. as “aggravated felonies”. Such convictions may result in permanent removal (deportation) from the U.S. By modifying the sentence, for example, from one year to 364 days, we can change the classification from an aggravated felony to a simple felony which may not be used as a basis for deportation by the U.S.C.I.S. or by the immigration courts. Removal proceedings are initiated in order to remove a person from the United States and deport his back to his own country or to a third country of his choice provided the third country is willing to accept him. Removal proceedings can be initiated for both detained and non detained persons. For those who are already detained an application for posting bond may also be required. Removal proceedings against a person living in United States can be initiated for a number of reasons and it will not be possible to capture them all on this page. Nevertheless, the most common grounds for placing someone in removal proceedings can be denial of a petition/application by USCIS; denial of asylum; any past criminal conviction; any allegation of fraud etc. For criminal convictions also see our section on post conviction relief. Student visa is available for the international students outside United States intending to come to United States temporarily for studies. If the applicant is already in United States in another non immigrant category, for example tourist visa, our office can help you file for the change of status into that of a student. On the other hand if the student is outside United States and is applying for the F-1 visa through the U.S consulate then the Attorney’s role becomes very limited. A country fis designated TPS due to conditions in the country which temporarily prevent the country's nationals from returning to that country safely, or in certain circumstances, where the country is unable to handle the return of its nationals in an adequate matter. USCIS may grant TPS to eligible nationals of certain countries who are already in the United States. In cases where the applicant is waiting on naturalization or permanent residency for a very long time, where the cases have fallen outside the normal processing time without any specific reason given by USCIS; or for the reason that the case is pending FBI background check, the writ of Mandamus can really push the case to reach a final adjudication. Basically, a Writ of Mandamus is filed against the USCIS to get a Federal Judge to order the USCIS to do what it is required to do anyway but, for some reason, is just not doing. Technically, the claim is filed under 8 United States Code 1447(B). Usually, the government’s answer is that it’s doing a thorough, time-consuming security check and that’s why the process is taking so long. Federal Courts, however, have not been reluctant to order the government to act and recently the United States District Court all across U.S are becoming more & more open to such claims.
